And if I cancel everything?

DEAR TRAVELLER: With my family we booked a cruise on the Nile - including two-day stay in Cairo - starting in early April. We very much to this trip, but frankly, given what happens in Egypt, we do not feel safer and we would like to cancel it. The agency with whom we booked, however, asks us to pay a penalty of 10% of the total (over 4,000 €).

But it should be fully compensated, since it is a supervening event not attributable to the parties? What do you advise me to do? Victoria Lorenzi DEAR READER: It is impossible to predict whether the date of his departure will force the Ministry of Foreign Affairs to discourage travel in Egypt and particularly Cairo, where she will stay.

If in the days before the start the goal was not recommended and the tour operator cancel the trip, the tourist would be entitled to take a substitute package or get a refund of the amount already paid. Even if the tour operator decided to still make the trip, despite the unfavorable opinion of the MFA, and instead you would prefer not to leave because of the seriousness of the situation, will consider the contract terminated, having failed the purpose of the travel package purchased , and then will get a refund of the entire amount in advance, without applying any penalty.

Different, however, the case in which the Ministry does not advise against the goal: his right to follow the recession contract with the operator. If you were already sure of not wanting to leave for Egypt, however, the situation will evolve, you may choose to immediately cancel the trip in order to pay a penalty less than that would be required to pay under that date.
